Norwegian Cruise Line Faces Legal Challenges
Norwegian Cruise Line is currently dealing with two separate personal injury lawsuits. These cases, filed in March 2026, involve claims of negligence in distinct incidents. Both incidents occurred in early 2025, one onboard the Norwegian Escape and the other during a shore excursion with Norwegian Joy.
Onboard Incident Raises Safety Concerns
The first lawsuit was initiated by Donka Kennedy on 2nd March 2026. She alleges she was injured on the Norwegian Escape. The incident happened on 31st January 2025 when she slipped on a slippery substance near the ship’s swimming pool on Deck 16. Kennedy was heading to the Garden Café buffet when she fell, fracturing her left femur. This injury required surgery and ongoing physical therapy.
Kennedy’s legal team claims the cruise line neglected to maintain the area properly. They argue that there were no adequate warnings about the hazard. The lawsuit also criticises the crew for not inspecting the busy pool deck sufficiently. It suggests that better non-slip flooring or cleaning measures could have reduced the risk. Norwegian Cruise Line has not commented publicly on these allegations. There is no available evidence confirming the conditions at the time of the incident.
Pool Deck Safety Under Scrutiny
Kennedy’s case highlights concerns about safety procedures on pool decks. These areas are known for wet conditions due to constant guest activity. Norwegian Cruise Line asserts that its ships have American Red Cross-certified lifeguards and slip-resistant surfaces. They also enforce safety rules, such as prohibiting running and requiring supervision for children under 12. However, the lawsuit argues these measures were inadequate in this instance. Details about Kennedy’s footwear or other contributing factors have not been disclosed. Despite the lawsuit, Norwegian Escape continues its Caribbean itineraries from New Orleans.
Shore Excursion Incident Leads to Second Claim
The second lawsuit was filed by Kelly Damron on 18th March 2026. Damron was a passenger on Norwegian Joy and was involved in an ATV accident during a shore excursion in Roatan, Honduras. The incident occurred on 19th March 2025 during the “Buggy Eco-Adventure & Mayan Eden Park” tour. This tour involved navigating steep terrain in off-road vehicles.
According to the claim, Damron lost control of her ATV while trying to pass a stalled buggy on a hill. The vehicle overturned and landed on top of her. The claim states that as Damron attempted to manoeuvre safely around the buggy, she began descending the steep hill and tried to brake. The steepness and dangerous conditions contributed to the accident.
These lawsuits highlight the importance of safety, both onboard and during excursions. Cruise holidaygoers should be aware of potential risks and take necessary precautions. Norwegian Cruise Line’s response to these claims will be closely watched by the cruise community.
